EEXI AND CII – THE LEGISLATION

In June 2021 the IMO, during MEPC 76 has adopted amendments to MARPOL Annex VI, which require vessels over 400 GT (except those build in accordance to EEDI phase 2 and 3) to calculate their attained EEXI and if found non-compliant (higher value) with the required EEXI, to implement such modifications as necessary to meet the requirements.

The amendments will enter into force in November 2022 and vessels will be required to comply by their next scheduled survey – annual, intermediate or renewal – for the International Air Pollution Prevention Certificate (IAPPC) to be issued or endorsed, or the initial survey before the ship enters service for the International Energy Efficiency Certificate (IEEC) to be issued, whichever occurs first on or after 1 January 2023.

In addition to the amendments concerning the EEXI, the adopted changes also provide that applicable vessels (the same ship types as EEXI but of 5,000 GT and above and adding cruise ships using conventional propulsion) will need to demonstrate reductions of carbon intensity between January 2023 and 2030. The Carbon Intensity Indicator (CII) is a measure of how efficiently a ship transports goods or passengers and is given in grams of CO2 emitted per cargo-carrying capacity and nautical mile. The ship is then given an annual rating ranging from A to E, whereby the rating thresholds will become increasingly stringent towards 2030, therefore establishing a continuous verification process is of paramount importance.

The yearly CII is calculated based on reported IMO DCS data and the ship is given a rating from A to E. For ships that achieve a D rating for three consecutive years or an E rating in a single year, a corrective action plan needs to be developed as part of the SEEMP and approved.
